Mr. Powers is the fourth generation of his family to attend Michigan State University, where Mr. Powers graduated from the Michigan State University College of Law. In addition to earning his Juris Doctorate, Mr. Powers holds dual specialty certifications from Michigan State University College of Law in Corporate Law and Communications & Intellectual Property Law. These dual specialty certifications provided Mr. Powers with a strong foundation in contract law and intellectual property considerations that estates often face, including disputes over copyright (i.e., royalties provided to an estate for late family’s member novel) and patents (i.e., royalties provided to an estate for late family member’s invention).

Mr. Powers has extensive estate experience drafting and reviewing complex estate plans including multifaceted trust agreements, wills, advance healthcare directives, and powers of attorney as well as counseling and consulting on estate matters and procedure. In addition, Mr. Powers has assisted in successful estate litigation matters including favorable six figure settlements in will challenges.

A native Floridian, Mr. Powers enjoys spending time on the ocean, watching college and professional football, traveling and spending time with his family and friends.

Representative Cases

  • Represented unmarried individual in drafting an estate plan, which included a pet trust for the care of her canine should the testator predecease her pet.
  • Represented affluent married couple with minor in the drafting of their estate plan, which included complex trust documents pertaining to the deposition of assets to their children upon certain conditions precedent (i.e., graduating from college).
  • Successfully advised heir regarding intellectual property rights associated with music distributed to heir upon death of his parent.
  • Represented affluent married couple in the drafting of their estate plan, which included complex trust instruments to account for one of the spouses who was not a United States citizen.
  • Successfully advised heir regarding termination of the transfer of a copyrighted work of parent pursuant to § 203 of the Copyright Act.
  • Represented widowed individual with multiple, adult children in drafting an estate plan, which included a complex advance healthcare directive to confirm with the individual’s religious beliefs.
  • Represented affluent married couple in the drafting of their estate plan, which included real property owned outside the United States.
  • Represented clients in advising and drafting codicil to former last will and testament that allowed them to avoid unnecessary probate problems.
  • Represented clients in advising incorporation and implementation of digital rights in their estate plan to account for the ability of their executors, trustees, heirs and beneficiaries, as applicable, to access protected websites requiring login credentials to access sensitive information of a decedent (i.e., bank account, social media, etc.).
